Mediator/Arbitrator
Marc Alexander brings over 35 years of litigation experience to his practice
as a neutral, including bench and jury trials, binding arbitrations, mediations,
and appellate work in state and federal courts. Before joining ARC, Marc served
as of counsel and as a shareholder at AlvaradoSmith PC. Previously, he had been
a shareholder at McKittrick Jackson DeMarco & Peckenpaugh, and an associate at
Irell and Manella.
Early in his legal career, Marc specialized in intellectual property cases, and over
time his practice broadened to include business, real estate, lender-borrower,
landlord-tenant, unfair competition, employment, attorney fee, and other disputes.
Marc has mediated hundreds of state and federal cases, as well as pre-litigation
disputes. Since 2012, he has published a blog entitled California Mediation and
Arbitration, and since 2008, he has been a co-contributor to the blog California
Attorney’s Fees. His involvement with the attorney’s fees blog aligned with
the insight that all too often attorney’s fees become the tail that wags the dog
in litigation. This led naturally to his interest in ADR as a pragmatic means of
achieving resolution that is also economical, efficient, and offers greater agency
to the participants than litigation. Marc believes preparation, patience, and trust
building are keys to successful dispute resolution. His personal style is calm and
friendly. Depending on circumstances and the needs of the parties, Marc will be
facilitative or evaluative. He works hard to seek common ground, to avoid impasse,
and to close when resolution is within reach.
